Dear Chief Anton and Ms. Collins:
We have reviewed your joint letter of January 16, 1997, regarding accepting and denying protests against Water Right Application 30498.
On November 5, 1996, the California Sportfishing Protection Alliance and the Santa Barbara Urban Creeks Council filed a formal joint protest against Water Right Application 30498. The CSPA and SBUCC protest was filed with the Division in a timely manner. The CSPA and SBUCC protest was served on 16 parties, plus other interested parties, as shown on the CSPA and SBUCC service list, including the applicant, based on the applicant's mailing address and the agent's name in the Division's public notice of October 11, 1996. The CSPA and SBUCC joint protest was served on Mr. Larry Attaway, Mr. Ed Dito, Mr. Steve Herrera, and Mr. Jim Canaday of your staff. As I recall, Mr. Attaway was provided with the original. Please consult with the above mentioned staff people.
The applicant's mailing address in the Division's public notice of October 11, 1996 shows as follow: CALMAT Company, c/o G. Thomas Davis, P.O. Box 2950, Terminal Annex, Los Angeles, CA 90051. The CSPA protest was mailed to that mailing address, and to that agent, and the CSPA protest was not returned by the U.S. Postal Service to the CSPA.
CALMAT Company's mailing address in your letter of January 17, 1996, is different than the Division's public notice of WR Application 30498, including the name of the agent. The mailing address in your letter of January 16, 1997, shows the mailing address and the agent of CALMAT Company as follows: CALMAT Company, c/o Mr. Robert H. Born, Consulting Engineer, 15 Anacapri, Laguna Niguel, CA 92677.
In your letter of January 16, 1997, you indicated that copies of each protest were being forwarded by the Division to CALMAT. And that CALMAT was given 45 days to respond to each protest. Please forward a copy of the joint CSPA and SBUCC protest to CALMAT so that the applicant can also respond to our joint protest.
Your joint letter of January 16, 1997, did not acknowledge that the California Sportfishing Protection Alliance and the Santa Barbara Urban Creeks Council filed a joint protest against Water Right Application 30497. Nor did your joint letter accept or deny our protest.
We are requesting you ackowledge that the CSPA and the SBUCC filed a joint protest against Water Right Application 30498. We are requesting you accept the CSPA and SBUCC joint protest. In the event you deny the protest, provide the reasons why the environmental protest is not being accepted by you.
The Division of Water Rights public notice for Water Right Application 30498 did not include any environmental information. Without this environmental information disclosure by the Division, it makes it impossible to file protests on environmental grounds. We recommend and urge you to make changes in the Division's water right application public notice process that provides the necessary environmental information. For the records, and as stated in the CSPA and SBUCC protest, the Santa Clara River sustains southern steelhead and their habitat. And that species of fish is being proposed for listing by the USNMFS as "endangered" in that area of California.
Please place Mr. Brian Trautwein, Director, of the SBUCC on the service list for Application 30498. His mailing address is listed below. Thank you.
In your letter of January 16, 1997, the mailing list did not include the mailing address of the L.A. County Waterworks District - Department of Public Works. For that reason we are unable to provide that party with a copy of this letter.
