Petition for Extension of Time and Change in Place of Use

 

Public Trust Protest by California Sportfishing Protection Alliance

 

 

The California Sportfishing Protection Alliance desire to protest

Application No. 29122 and WR Permit 20355 on environmental grounds.

 

We have reviewed the subject extension of time and change in place of

use and Notice of Petitions Requesting Changes in Water Right Permits

and Licenses, dated February 23, 1998.

 

The Russian River Watershed sustains Coho Salmon, and Steelhead Trout,

including other fish species and their habitat. Miller Creek sustains

fish and aquatic species and their habitat. Reductions and timing to the

natural flows affects fish and aquatic species and their habitat.

 

In the event Permit 20355 does not contain a mandatory daily minimum

streamflow requirement to protect fish and aquatic species and their

habitat, pursuant to Section 782, CCR, Title 23, the CSPA is requesting

the State Water Resources Control Board to order a mandatory daily

streamflow requirement.

 

The CSPA is requesting the same conditions as being required by the

SWRCB on pending water right applications.

 

In the event the permitee does not maintain a measuring device below

the point of diversion to measure the environmental water released to

protect fish and aquatic species and their habitat, pursuant to Section

846, CCR, Title 23, the CSPA is requesting the State Water Resources

Control Board to order a measuring device.

 

In the event Permit 20355 does contain a mandatory measuring device

requirement, and the measuring device has been installed and maintained

by the permittee, dismiss this protest.
