Dear Gentlemen:

 

On July 15, 1995 the CSPA filed a formal protest against the above mentioned water right applications. In the CSPA protest we requested ten (10) conditions in which the CSPA protest would be dismissed. Other protests were filed by interested parties against the applications.

 

Sometime in April, 1997, the Division made a submittal to the CSPA and other protestants. The CSPA mistakenly disregarded the submittal as simply an informational disclosure assocated with Application Nos. 29910 and 29911. However, it recently became known to the CSPA that the informational submittal contained a statement by the Division that if protestants did not respond within 45 days, their protests would be dismissed.

 

This week I discussed this matter with the staff of the Division and was surprised the Division would simply dismiss the CSPA protest and other protests.

 

Considering the applications were associated with the unauthorized use of the state's water and that no environmental mitigation measures were required by the Division because the applicant was operating the project without a valid water right permit from the Board; that the Board did not take any enforcement actions against the applicant; that the Division allowed the applicant to continue to divert water illegal while simply submitting water right applications; and that the protests were dismissed without due process; we believe the CSPA protests and other protests should be reinstated.

 

It is my understanding Mr. Pettit has been advised of the above mentioned problems by another protestant.

 

A written response would be appreciated.
