Dear Mr. Forge:

 

We have reviewed your letter to environmental protestants, dated December 23, 1994. On October 18, 1991 the CSPA filed a protest on environmental grounds against Application 29697 and 29680. Our specific concern in filing our protest was that the anadromous fisheries of the Navarro River were protected at all times by adequate daily flows. Your letter included proposed permit terms mitigation measures.

 

In the CSPA letter of October 9, 1993, we seriously questioned whether 100 cfs of water was sufficient to maintain public trust anadromous fish in the river.

We agree with the proposed permit terms mitigation measures of a 200 cfs bypass flow for Application 29679. We also agree that all points of diversion should be limited to a total of 2 cfs, and that said diversion should be made during the winter months. That 200 cfs flow condition should be the environmental flow standard for the river. We agree to dismiss our protest against Application 29679 provided said terms and conditions as written are contained in the water right permit.
