Lower Mokelumne River

 

One of the biggest water and anadromous fisheries battles ever in Northern California history has been on-going for the past several years or more between the CSPA and Committee to Save the Mokelumne (CSM) against the East Bay Municipal Utility District (EBMUD) in determining the amount of water to protect and restore the anadromous fisheries of the lower Mokelumne River adversely affected by the operation of EBMUD's Pardee and Camanche dams. In 1992, a long term hearing was held by the SWRCB concerning a complaint filed by the CSPA and CSM against EBMUD. To date and over five years later, the SWRCB has failed to make a decision on the complaint and the hearing record. The anadromous flow issues are also pending before FERC. Recently the California Department of Fish and Game (CDFG), and the U.S. Fish and Wildlife Service (USFWS) reached a closed door non-public private agreement with EBMUD which contravened state law (Fish and Game Code 5937), oral testimony (CDFG) before the SWRCB, and the results of scientific studies and recommendations by the CDFG and USFWS. Shown below are some of the CSPA activities with the SWRCB, FERC, and other agencies in recent years.
